Terms of agreement
PUBLIC OFFER AGREEMENT
for ordering, purchasing, selling and delivering goods
This Agreement is an official and public offer of the Seller to
conclude a contract of sale of the goods presented on the website www.monblanche.com.
This Agreement is public, meaning that, according to Article 633 of
the Civil Code of Ukraine, its terms are the same for all buyers, regardless of
their status (individual, legal entity, or individual entrepreneur), without
giving preference to one buyer over another.
By entering into this Agreement, the Buyer fully accepts the terms
and conditions of ordering, payment, delivery, return, and liability for
improper orders, as well as all other provisions of this Agreement.
1. DEFINITIONS
1.1. Public Offer (Offer) — a public proposal made by the Seller,
addressed to an indefinite number of persons, to conclude a distance sales
contract under the terms and conditions contained in this Offer.
1.2. Goods — the object of the agreement
between the Parties, which has been selected by the Buyer on the website of the
Online Store and placed in the shopping cart or already purchased from the
Seller by distance method.
1.3. Online Store — the Seller’s website www.monblanche.com, created for
concluding retail and wholesale sales contracts.
1.4. Buyer — a capable individual aged
18 or older who receives information from the Seller, places an order for
purposes not related to business activities, or a legal entity/individual
entrepreneur.

(also any legal entity entitled to use
the Mon Blanche trademark).
1.6. Order — specific items from the
assortment of Goods selected by the Buyer when placing an order.
1.7. Delivery — the transfer of Goods
from the Seller to the Buyer by an independent carrier or by employees of the
Online Store.
2. GENERAL PROVISIONS
2.1. This Agreement regulates the relationship between the Online
Store monblanche.com and Buyers.
2.2. The Agreement is concluded by full
and unconditional acceptance of its terms without a written signature.
2.3. The moment of acceptance is the
fact of payment for the order.
2.4. The Agreement has legal force
according to Articles 633, 641, 642 of the Civil Code of Ukraine.
2.5. The Parties guarantee their legal
capacity.
2.6. By placing an order, the Buyer
confirms that they:

have fully read and understood the terms of
this Agreement;

consent to the processing of personal data;
●
agree to the transfer of their contact details
to third parties for fulfillment of the order;
●
agree to receive informational messages.
2.7. The current version of the
Agreement is available on the website www.monblanche.com.
2.8. The Seller may change the terms of
this Agreement without prior notice to the Buyer.
2.9. The updated version of the
Agreement comes into force upon publication.
3. SUBJECT OF THE AGREEMENT
3.1. The Seller provides the Buyer with the opportunity to purchase
Goods for personal use.
3.2. The Seller ensures the availability
of the Goods for sale.
3.3. Product photos on the website may
differ from the actual appearance.
3.4. Product descriptions may contain
minor inaccuracies.
4. PRICE OF GOODS
4.1. Prices indicated on the website include taxes and are
determined in foreign currency, recalculated into UAH at the National Bank of
Ukraine exchange rate.
4.2. The Seller may change prices.
4.3. In the event of a price change, the
Seller informs the Buyer.
4.4. The Buyer may confirm or cancel the
order after such notification.
4.5. The price after payment cannot be
changed.
4.6. Delivery costs are indicated
separately.
4.7. Payment is considered completed
once funds are credited to the Seller’s account.
4.8. The cost of Goods does not include
delivery fees.
4.9. Payments are made by methods listed
on the website.
5. ORDER PLACEMENT
5.1. Orders are accepted via the website, Instagram @mon_blanche, or
by phone.
5.2. When placing an order, the Buyer
must provide:

delivery address,

email,
●
phone number.
5.3. The shopping cart displays all item
parameters.
5.4. The Seller may request additional
information.
5.5. The Buyer is responsible for the
accuracy of provided information.
5.6. After the order is placed, the
Buyer receives confirmation by email.
6. DELIVERY OF GOODS TO THE BUYER
6.1. Methods, procedures, and delivery times are specified on the
website in the “Information” section.
6.2. Delivery is carried out either by
employees of the Online Store or by third-party carriers according to delivery
terms.
6.3. Upon receipt, the Buyer must check
the Goods for compliance with qualitative and quantitative characteristics
(name, quantity, completeness) in the presence of the courier.
6.4. By signing the delivery note or
receipt, the Buyer confirms that there are no claims regarding quantity,
appearance, or completeness of the Goods.
6.5. Ownership and risk of accidental
loss or damage pass to the Buyer upon receipt or upon transfer to the Buyer’s
chosen delivery service.
7. INTERNATIONAL DELIVERY OF GOODS
7.1. The Seller carries out international delivery of Goods to
countries listed on the official website www.monblanche.com.
7.2. The cost of international delivery
is 35 (thirty-five) euros per order, regardless of destination, weight, or
number of items.
7.3. The stated delivery cost is fixed
and set exclusively by Mon Blanche, not by the carrier or postal service. It is
determined by the Seller based on logistics, packaging, and order handling
costs.
7.4. Payment for international delivery
is made by the Buyer when placing the order and is included in the total
purchase amount.
7.5. In case of the Buyer’s refusal to
receive the order after dispatch, the delivery cost is non-refundable as it
covers actual shipping expenses.
7.6. The delivery time depends on the
destination country and postal/customs schedules. The Seller is not responsible
for delays caused by circumstances beyond their control.
8. EXCHANGE
AND RETURN OF GOODS
8.1. Returns and exchanges of quality Goods are accepted within 14
calendar days from the date of receipt, provided the Goods were not used and
retain their original condition, consumer properties, seals, and labels.
8.2. Return shipping costs are borne by
the Buyer, except in cases of manufacturing defects or Seller’s error.
8.3. Upon return, the Seller refunds the
Buyer within 7 business days after receiving the returned Goods.
8.4. Refunds are made using the same
payment method used for purchase.
8.5. The Seller reserves the right to
deny a return if the Goods show signs of use.
9. LIABILITY OF THE PARTIES
9.1. The Seller is not responsible for non-fulfillment of
obligations due to force majeure circumstances.
9.2. The Seller is not responsible for
the actions of carriers.
9.3. The Buyer is responsible for the
accuracy of the data provided when placing an order.
9.4. If the Buyer fails to fulfill
payment obligations, the Seller may cancel the order.
10. CONFIDENTIALITY AND DATA PROTECTION
10.1. The Buyer’s personal data are used solely for order processing
and delivery.
10.2. The Seller undertakes not to
disclose the received data to third parties, except as required by law.
10.3. The Seller may use contact data
for marketing communications (emails, SMS).
10.4. The Buyer may unsubscribe from
such communications at any time.
11. FORCE MAJEURE
11.1. The Parties are released from liability for full or partial
non-fulfillment of obligations caused by force majeure (war, natural disasters,
strikes, blockades, etc.).
11.2. The affected Party must notify the
other Party within 5 days of such circumstances.
12. DISPUTE RESOLUTION
12.1. All disputes and disagreements are resolved through
negotiations.
12.2. If the Parties fail to reach an
agreement, the dispute shall be settled in court according to the current
legislation of Ukraine.
13. TERM OF THE AGREEMENT
13.1. This Agreement comes into force upon its acceptance by the
Buyer and remains valid until the Parties fully perform their obligations.
13.2. The Seller has the right to amend
the Agreement unilaterally by publishing a new version on the website.
